2. Es wurde 1984 durch die Bundesregierung von Tamil Nadu als islamisches Minderheitencollege gegründet und bietet Technische Undergraduate - und Postgraduate -Abschlüsse an. Nach der Rechtsprechung des EGMR zu Art. 6 EMRK ist bei der Beurteilung der Frage, ob einem Antragsteller hinreichende gerichtliche Kontrolle zur Verfügung stand, auf die Befugnisse des betreffenden Rechtsprechungsorgans und Faktoren wie die folgenden abzustellen: „(a) auf den Gegenstand der angefochtenen Entscheidung, insbesondere ob es sich um ein Spezialgebiet handelt, welches Fachkenntnis oder Berufserfahrung erfordert, und ob diese eine behördliche Ermessensausübung beinhaltete, und falls ja, inwieweit; (b) auf die Art und Weise, in der die Entscheidung getroffen wurde, insbesondere die im Verfahren vor dem entscheidenden Organ zur Verfügung stehenden Verfahrensgarantien, sowie (c) auf den Gegenstand des Streits, unter anderem die gewünschte rechtliche Abhilfe und ihre Begründung in tatsächlicher Hinsicht“(74).

According to the case-law of the ECtHR with regard to Article 6 ECHR, the sufficiency of the judicial review available to an applicant is assessed with regard to the powers of the judicial body in question and to factors such as: ‘(a) the subject matter of the decision appealed against, in particular, whether or not it concerned a specialised issue requiring professional knowledge or experience and whether it involved the exercise of administrative discretion and if, so, to what extent; (b) the manner in which that decision was arrived at, in particular, the procedural guarantees available in the proceedings before the adjudicatory body; and (c) the content of the dispute, including the desired and actual grounds of appeal’.
