4. Im vorliegenden Fall dagegen sei Portugal, das eine Sardellenquote im ICES-Gebiet IX besitze, nunmehr berechtigt, einen Teil dieser Quote (bis zu 5 008 t) in den Gewässern des ICES-Gebietes VIII, die sich unter französischer Hoheitsgewalt oder Gerichtsbarkeit befänden, zu fischen.

In this case, by contrast, Portugal, which holds an anchovy quota in ICES area IX, is now allowed to fish part of that quota (namely 5 008 tonnes) in ICES area VIII waters under the sovereignty or jurisdiction of France.

Der Anwendungsbereich wird geringfügig geändert, um auch ,Ankergebiete" zu erfassen, sodass Öltankschiffe ab 5000 Tonnen Tragfähigkeit erfasst sind, die in einen Hafen, einen Vorhafen oder ein Ankergebiet unter der Gerichtsbarkeit eines Mitgliedstaats einlaufen, unabhängig davon, welche Flagge sie führen, oder die die Flagge eines Mitgliedstaats führen.

The scope is slightly amended to also cover "anchorage areas", that is to cover oil tankers of 5000 tons deadweight and above that are entering into a port, offshore terminal or anchorage areas under the jurisdiction of a Member State, irrespective of their flag, or flying the flag of a Member State.

DAMIT SOLL ERREICHT WERDEN, DASS DIE GEMEINSCHAFT IHRE AUFGABEN IN VOLLER UNABHÄNGIGKEIT ERFÜLLEN KANN .

8. 21 Zur Beantwortung der ersten Frage ist darauf hinzuweisen, daß der Gerichtshof im Urteil vom 30. Juni 1966 in der Rechtssache 61/65 (Vaassen-Göbbels, Slg. 1966, 584) den Begriff des Gerichts im Sinne von Artikel 177 EWG-Vertrag definiert und eine Reihe von Kriterien genannt hat, die ein solches Organ erfuellen muß, wie z. B. gesetzliche Grundlage, ständiger Charakter, obligatorische Gerichtsbarkeit, streitiges Verfahren und Anwendung von Rechtsnormen.

21 In order to answer the first question, it should be noted that, as the Court held in its judgment in Case 61/65 Vaassen-Goebbels [1966] ECR 377, the concept of a court or tribunal within the meaning of Article 177 of the Treaty necessarily implies that such a forum should satisfy a number of criteria; it must be established by law, have a permanent existence, exercise binding jurisdiction, be bound by rules of adversary procedure and apply the rule of law.
