In the Golak Nath case , the Supreme Court by a 6 : 5 majority reversed its earlier decisions and held that the fundamental rights enshrined in the Constitution were transcendental and immutable , that article 368 of the Constitution laid down only the procedure for amendment and did not give to Parliament any substantive power to amend the Constitution or any constituent power distinct or separate from its ordinary legislative power , that a Constitution Amendment Act was also law within the meaning of article 13 and as such Parliament could not take away or abridge the fundamental rights even through a Constitution Amendment Act passed under article 368 .

गोलकनाथ के मामले में उच्चतम न्यायालय ने 6 : 5 के बहुमत द्वारा अपने पूर्ववर्ती निर्णयों को उलट दिया और कहा कि संविधान में प्रतिष्ठित मूल अधिकार अपरिवर्तनीय हैं , अनुच्छेद 368 में केवल संशोधन - प्रक्रिया का उपबंध है और उसमें संसद को संविधान - संशोधन की कोई मूल शक्ति या उसकी विधायी शक्ति से अलग थलग या अलग पहचान वाली कोई संविधायी शक्ति प्रदान नहीं की गई है , संविधान - संशोधन अधिनियम भी अनुच्छेद 13 के अर्थांतर्गत विधि है , अत : अनुच्छेद 368 के अधीन पारित संविधान - संशोधन अधिनियम के द्वारा भी संसद न तो मूल अधिकारों को छीन सकती है और न ही उन्हें कम कर सकती है .

गोलक नाथ के मामले में उच्चतम न्यायालय ने 6 : 5 के बहुमत से अपने पहले फैसलों को उलट दिया और यह फैसला सुनाया कि सम्मिलित मूल अधिकार अपरिवर्तनीय हैं , कि संविधान के अनुच्छेद 368 में केवल संशोधन करने की प्रक्रिया ही निर्धारित है और उसके द्वारा संविधान में संशोधन करने की कोई मूल शक्ति अथवा साधारण विधायी शक्ति से अलग कोई संविधायी शक्ति संसद को प्रदान नहीं की गई है , कि संविधान संशोधन अधिनियम भी अनुच्छेद 13 के अर्थों में एक विधि है और इस प्रकार संसद अनुच्छेद 368 के अधीन पास किए गए किसी संविधान संशोधन अधिनियम के द्वारा भी मूल अधिकार समाप्त नहीं कर सकती या इनमें कोई कमी नहीं कर सकती .
